I need to know how many cubic yards of sand in 40 tons

If it's clean, dry sand in a loose state, approximately 33.3 cubic yards. Dry, loose sand weighs approximately 2400 pounds a yard.

If the sand is wet, it depends on how much moisture it contains. Wet sand can weigh over 3100 pounds per yard in a loose state. IF it weighs 3100 pounds a cubic yard, 25.8 yards.
